Terms of Use — Lucky Names

1. Eligibility

You must be at least 18 years old, or the age of majority in your place of residence, to use the App. By using the App you represent that you meet this requirement. The App is intended for parents and parents-to-be — it is not directed at children.

2. What Lucky Names is

Lucky Names helps you explore, filter, save, and compare baby names, and generate full-name combinations. It's a discovery and decision-support tool. It is not legal, medical, or professional advice — name meanings, cultural/heritage information, popularity data, and similar content are provided for informational and inspirational purposes only. Always independently verify anything that matters for a legal or official purpose (e.g., birth certificate name rules, which vary by jurisdiction).

3. License to use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to use Lucky Names on devices you own or control, for your own personal, non-commercial use, subject to these Terms. No other licenses are granted, by implication or otherwise.

4. Our content and intellectual property

The App and its content — including the name database, name descriptions and meanings, texts, designs, graphics, software, and the Lucky Names name and logo — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, distribute, scrape, or create derivative works from the App or its content, or use our name or logo, without our prior written consent.

Feedback. If you send us ideas, suggestions, or other feedback about the App — including through the in-app feedback and "report a name" forms — we may use it freely and without obligation to you, and you assign to us any rights needed for us to do so.

5. Your content

Names, preferences, saved lists, and combinations you create in the App are yours. Where any of this data is processed by us (e.g., anonymized analytics, shared rooms, or iCloud sync via Apple's infrastructure) it's handled as described in our Privacy Policy. To the extent needed to operate features you use (e.g., syncing your lists, showing your likes and display name to other members of a room you join, or sharing content with people you invite), you grant us a limited, non-exclusive license to process, store, and transmit that content solely to provide those features.

6. Subscriptions & purchases

Some features may be offered as a paid auto-renewing subscription or a one-time purchase ("Lifetime") through Apple's App Store, using StoreKit. Billing, renewal, and cancellation are managed entirely through your Apple ID / App Store account settings — refund requests should go through Apple, per their standard policies, not to us directly. Pricing and included features may change; if they do, we'll make the current offering clear before you purchase.

Purchases are tied to your Apple ID. Purchases are linked to the Apple ID used at the time of purchase and are not transferable to another account; whether family members can use a purchase is governed by Apple's Family Sharing settings. In a shared room, premium status belongs to the individual member who purchased it — it is not shared with or inherited by other room members.

Auto-renewing subscriptions. If you purchase a subscription: payment is charged to your Apple ID account at confirmation of purchase; the subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period; your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price; you can manage or cancel your subscription any time in your device's Account Settings after purchase; any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.

"Lifetime" purchases. A one-time "Lifetime" purchase unlocks the relevant feature(s) for as long as (a) you retain access to the App in the version/edition it's offered in, and (b) we continue to operate and support Lucky Names. It is not a guarantee of indefinite service independent of the App's continued existence. If we ever discontinue Lucky Names or a Lifetime-purchased feature, we'll make reasonable efforts to give advance notice, but we do not guarantee a refund beyond what Apple's own refund policies independently provide, since we don't control or receive your original payment directly.

7. Acceptable use

You agree not to: reverse-engineer or decompile the App beyond what's legally permitted; use the App or any shared feature (rooms, invites, nicknames) to harass, harm, deceive, or infringe the rights of others; submit unlawful or abusive content through feedback or reports; interfere with the App's normal operation or its backend services; scrape, mine, or bulk-extract data from the App; or use the App for any unlawful purpose.

8. Choosing together — rooms & invites

Some features let you create or join a shared "room" with people you invite (up to the stated member limit) so you can like names together and see overlaps.

• Invite links. A room is joined via an invite link or code. Anyone who has the link can join until the room is full or closed — so share it only with people you actually want in your room. You are responsible for where your invite link ends up. If a link leaks, the room owner can remove members or close the room.
• What others see. Members of your room can see your display name or nickname, your activity in the room, and the names you've liked that overlap with theirs — as described in the Privacy Policy. Don't join a room, or invite others into one, if you're not comfortable with that.
• Room management. The room owner may rename or remove members and close the room; we may also suspend or close rooms that violate these Terms. Rooms expire automatically after a period of inactivity (currently 90 days), and expired or closed rooms — including their shared data — are deleted and can't be restored.
• People you invite. You're responsible for making sure the people you invite are willing participants.

9. Service changes, availability & backups

We may add, change, suspend, or discontinue any feature — including online features like rooms — at any time; where a change materially reduces paid functionality, Section 6 (and Apple's refund policies) governs. We are not obligated to back up your data: on-device and iCloud data is under your control, and shared-room data is deleted when a room closes or expires.

10. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including (to the extent permitted by law) any warranty of accuracy, merchantability, or fitness for a particular purpose. Name meanings, origin, popularity, and similar data are compiled from public sources and our own research on a best-effort basis; we don't guarantee completeness or absolute accuracy.

11. Limitation of liability

To the maximum extent permitted by law, Lucky Names and its operator will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App — including any loss of data from device loss, room expiry or closure, or feature discontinuation. Our total liability for any claim relating to the App is limited to the amount you paid us (if any) in the 12 months before the claim.

Where limits don't apply. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. If those laws apply to you, some or all of the above exclusions may not apply, and any warranty that cannot be excluded is limited in duration to the minimum period permitted by applicable law. Nothing in these Terms limits liability that cannot be limited by law, or affects mandatory consumer rights in your country of residence.

12. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and reasonable expenses (including legal fees) brought by a third party arising out of your violation of these Terms, your misuse of the App (including misuse of rooms, invites, or nicknames to harm another person), or your violation of applicable law.

13. Apple App Store terms

The App is distributed through Apple's App Store, and Apple's standard licensed-application terms apply in addition to these Terms. You acknowledge that: these Terms are between you and us, not Apple, and Apple is not responsible for the App or any claims relating to it; we (not Apple) are responsible for maintenance, support, and any product warranties, and in the event of a warranty failure Apple will refund the purchase price (if any), with no further Apple obligation; you are not located in a U.S.-embargoed or "terrorist-supporting" country and are not on any U.S. prohibited-parties list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Suspension & termination

We may restrict, suspend, or terminate your access to the App — including previously purchased features — if we reasonably believe you have violated these Terms, engaged in fraud or abuse (including payment fraud, chargeback abuse, or attempts to circumvent purchase requirements), or misused rooms, invites, or any shared feature to harm another person. Where practical we'll try to notify you, but we may act immediately where fraud or abuse is involved. Restricting access for cause does not entitle you to a refund; any refund for a disputed payment is handled by Apple per their own policies, not by us directly, since Apple processes all payments for the App.

You may stop using the App and delete it at any time. The in-app "Delete all my data" option removes your data as described in the Privacy Policy.

Survival. Sections 4, 5, 10, 11, 12, and 15–17 survive any termination of these Terms.

15. Changes to these Terms

We may update these Terms as the App evolves. If we make material changes, we'll give notice — by an in-app notice, or by posting the updated Terms here with a new "Last updated" date — at least 7 days before the changes take effect (except changes required by law or addressing security/abuse, which may take effect immediately). Continued use of the App after the effective date means you accept the update; if you don't agree, stop using the App and delete it.

16. Governing law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles, and any dispute is subject to the jurisdiction of the courts of Lisbon, Portugal — in each case without prejudice to any mandatory consumer-protection rules of the country where you habitually reside, which remain unaffected.

17. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in effect, and the invalid provision is deemed modified to the minimum extent needed to make it valid. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
